1. Agreement and eligibility

By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

• You must be at least 18 years old to create an account. Accounts are for teachers, tutors, school staff and other education professionals.
• Students do not create accounts. They may use activities a teacher shares with them, under the teacher's and school's supervision and responsibility (section 10).
• If you use the Service for a school, district or other organization, you confirm you are authorized to do so and, where you accept these Terms for it, to bind it. If your organization has a separate signed agreement with us, that agreement controls where it conflicts with these Terms.

2. The Service

EasyClass helps educators plan, create and teach with AI: an AI assistant; documents, worksheets, slides and quizzes; AI-assisted grading and feedback; classroom apps built with AI; display boards, seating charts, newsletters and other classroom tools; activities students open by link or code (quizzes, assignments, live sessions, polls, flashcards, feedback pages and classroom apps); voice mode; and integrations such as Google Classroom.

We change and improve the Service often. We may add, change or remove features, models and limits, and some features may be labeled beta or experimental and may not work as expected. We don't promise that the Service, or any feature, will always be available or uninterrupted.

3. Your account

• Give accurate information and keep it up to date.
• Keep your sign-in details secure. You are responsible for activity under your account. Tell us right away at support@easyclass.ai if you suspect unauthorized access.
• Each account is for one person. Don't share accounts or create multiple accounts to get around limits or trials.
• With your request, or when needed to investigate a problem, abuse or a safety concern, our staff may access your account and content as described in the Privacy Policy.

4. Plans, payments and renewals

• Plans. We offer a free plan and paid plans (such as Pro and school plans). Features, prices and limits of each plan are shown on our pricing page and in the Service, and may change as described below.
• Billing. Paid plans are billed in advance, monthly or yearly, through Stripe. Prices are in US dollars unless stated otherwise, and taxes may apply.
• Automatic renewal. Subscriptions renew automatically at the end of each billing period at the then-current price until you cancel. You authorize us and Stripe to charge your payment method for each renewal. You can cancel any time at easyclass.ai/billing; cancellation takes effect at the end of the current period.
• Price changes. We will give you at least 30 days' notice of a price increase for your subscription. It takes effect at your next renewal after the notice, and you can cancel before then.
• Failed payments. If a payment fails, we may retry it, and we may suspend paid features or move your account to the free plan until it is paid.
• School plans. School and district plans may be governed by an order form, quote or separate agreement.

5. Refunds and cancellations

5.1 How to cancel

Cancel any time at easyclass.ai/billing, or email support@easyclass.ai. Your plan stays active until the end of the period you paid for, then your account moves to the free plan. Your content is kept.

5.2 30-day money-back guarantee

• Your first Pro payment, monthly or annual, can be refunded in full within 30 days of that payment.
• The guarantee can be used once per account.
• When you get the refund, your subscription is canceled right away and your account goes back to the free plan. Your content and data are kept.
• Renewals and later payments are not covered, and neither are plans that started with a free trial or school plans.
• After the 30 days, payments are not refunded, including for partial billing periods.

How to request a refund: go to easyclass.ai/billing and choose "Refund my payment". You can also email support@easyclass.ai with your account email. Refunds go back to your original payment method, usually within 5 to 10 business days. We review any other refund request case by case. Where the law gives you additional refund or cancellation rights, those rights apply.

5.3 Chargebacks

Please contact us before disputing a charge with your bank. We may suspend an account while a chargeback is open.

6. Free plan, trials and limits

• Free plan. The free plan includes limited use, such as a set number of AI chat messages each month and of AI-graded papers in total. The current limits are shown in the Service and may change.
• Free trials. If you start a trial that asks for a payment method, your paid subscription begins automatically when the trial ends unless you cancel before then. We show the trial end date when you start it.
• Fair use. All plans, including paid plans described as unlimited, are subject to reasonable rate limits and fair-use limits that protect the Service and other users. We may slow down or pause use that is automated, abusive or far above normal classroom use.
• Promotions. Promotional offers and free access we grant are subject to the terms shown with them, can't be combined unless stated, and may end on the date given.

7. Acceptable use

Use the Service for legitimate educational purposes and in line with the law and your school's policies. Don't:

• Create, upload or share anything illegal, harmful, hateful, harassing, sexually explicit, or that sexualizes or endangers minors.
• Use the Service to bully, intimidate or deceive students or anyone else, or to impersonate others.
• Upload content you don't have the right to use, or that infringes someone else's intellectual property or privacy.
• Collect or use student information for anything other than education, or add more personal information about students than you need.
• Build classroom apps or activities that collect sensitive personal information from students, track them, link them to outside sites designed to collect their data, or show them advertising.
• Probe, scan, hack, overload or disrupt the Service; get around limits, paywalls or security; or access other users' data.
• Scrape the Service, use it to build a competing product, or resell or white-label it without our written agreement.
• Use AI features to generate spam or malware, to extract model details, or in violation of our AI providers' usage policies.

We may remove content, disable links or apps, and suspend or close accounts that break these rules (section 17).

8. Your content

8.1 You own your content

"Your Content" means what you and your students put into the Service and what the Service produces for you, including prompts, chats, documents, apps, boards, uploads and student responses. As between you and us, you (or your school) own Your Content.

8.2 What you allow us to do

You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit and display Your Content only as needed to:

• provide the Service to you and the people you share with, including sending content to AI and other service providers listed in the Privacy Policy;
• support you, keep the Service secure, and investigate abuse or safety concerns;
• improve the Service, including review of samples of content by authorized staff to improve our prompts, templates and design. We don't train our own AI models on Your Content or on student information, and we don't sell Your Content;
• show content you publish to the gallery or share by link to others as you choose (section 11).

This license ends when Your Content is deleted from the Service, except for content you shared or published that others already copied, and copies in backups until they are overwritten.

8.3 Your responsibility

You are responsible for Your Content and for having the rights and permissions needed to upload and share it. Keep your own copies of anything important. We may remove content we believe breaks these Terms or the law.

9. AI features

• AI can be wrong. AI output can be inaccurate, incomplete, biased, out of date or inappropriate, and similar requests can give different results. Review and edit AI content before using it with students.
• Grading and feedback. AI grades, scores and feedback are suggestions to help you. You are responsible for checking them and for every grade and decision you make. Don't rely on AI alone for decisions that significantly affect a student, such as final grades, placement, discipline or special education decisions.
• Students using AI. If you turn on features where students interact with AI (such as "Ask about my feedback" or classroom apps that use AI), you are responsible for deciding they are appropriate for your students and for supervising their use. We use safety filters, but they can't catch everything.
• Output rights. As between you and us, you own the AI output you create with the Service, to the extent the law allows. Similar output may be produced for other users. We don't promise that output is free of third-party rights or protected by copyright.
• Providers. AI features are powered by third-party model providers, and you agree not to use them in violation of those providers' usage policies.

10. Students and student data

10.1 Your responsibilities

If you use the Service with students or add student information, you confirm that:

• you are authorized by your school (or, for tutors and others, by parents or guardians) to use the Service with your students and to provide their information to us for educational purposes;
• where COPPA applies, you or your school consent on behalf of parents to the collection of student information for the school's educational purposes, and have given any notices your school or the law requires;
• you follow FERPA, state student privacy laws and your school's policies, and you use student information only for educational purposes;
• you supervise students' use of activities and student-facing AI features you share.

10.2 Our commitments

We handle student information as described in our Privacy Policy: we use it only to provide the Service, never sell it, never use it for advertising, and don't run analytics on student pages. Student information is kept until you or your school delete it or ask us to, or your account is deleted.

10.3 Deleting student data

• Delete responses, grading batches, live sessions, polls and app results in the feature where they appear, where that feature offers it.
• Use Profile → Privacy → "Delete student data" to delete responses to your shared quizzes, assignments and spiral reviews, and older grading sessions.
• Email privacy@easyclass.ai to have us delete any other student information, or all of it. We complete these requests within 30 days.

11. Sharing, links and the app gallery

• Items you share by link or code (for example quizzes, slides, newsletters, results or classroom app links) can be opened by anyone who has the link or code. Share them only with the people you intend to, and turn sharing off when you no longer need it.
• If you publish a classroom app or other item to a public gallery, you allow other EasyClass users to view, use, copy, change and share it within the Service, and you confirm it contains no student information or other personal information. We may review, feature or remove gallery items at our discretion.
• Using another user's shared or gallery content is at your own risk; check it before using it with students.

12. Our intellectual property

The Service, including its software, design, templates and branding, belongs to EasyClass and its licensors. We give you a limited, personal, non-transferable right to use the Service under these Terms. Don't copy, modify, reverse engineer or redistribute the Service, or use our trademarks, except as the law allows or we agree in writing.

If you send us feedback or ideas, we may use them without owing you anything.

Copyright complaints. If you believe content on the Service infringes your copyright, email support@easyclass.ai with your contact details, the work, where it appears on the Service, a statement that you believe in good faith the use is not authorized, and a statement under penalty of perjury that your notice is accurate and you are the owner or authorized to act for the owner. We may remove the content and close repeat infringers' accounts.

13. Third-party services

The Service works with and links to services we don't control, such as Google (Sign-In, Classroom, Drive, Docs), Stripe, AI model providers, and websites or media you or others embed. Your use of them is subject to their terms and policies, and we are not responsible for them. You can remove EasyClass's access to Google at any time in your Google Account settings.

14. Disclaimers

THE SERVICE, INCLUDING ALL AI OUTPUT, IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY AND UNINTERRUPTED OR ERROR-FREE OPERATION, TO THE FULLEST EXTENT THE LAW ALLOWS. WE DON'T WARRANT THAT AI OUTPUT, GRADES OR FEEDBACK ARE CORRECT, APPROPRIATE FOR YOUR STUDENTS, OR ALIGNED TO ANY CURRICULUM OR STANDARD, OR THAT CONTENT WILL NEVER BE LOST.

EasyClass is a tool for educators and does not replace professional judgment. You are responsible for what you use with students and for your educational decisions.

15. Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, EASYCLASS AND ITS OWNERS, EMPLOYEES, CONTRACTORS AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF WE WERE TOLD THEY WERE POSSIBLE.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND (B) ONE HUNDRED US DOLLARS (US $100).

Some places don't allow these exclusions or limits, so they apply to you only as far as the law allows. Nothing in these Terms limits liability that can't be limited by law.

16. Indemnification

To the extent the law allows, you will defend, indemnify and hold harmless EasyClass and its owners, employees and contractors from claims, damages, losses and costs (including reasonable attorneys' fees) arising from Your Content, your use of the Service, your breach of these Terms or the law, or your collection or use of student information. Public schools and agencies that are not permitted by law to give this indemnity are responsible only to the extent their law allows.

17. Suspension and termination

• By you. You can stop using the Service at any time, cancel your subscription at easyclass.ai/billing, and delete your account in Profile → Privacy → "Delete account" or by emailing privacy@easyclass.ai. If the in-app deletion can't finish, we will complete it within 30 days of your request.
• Export first. Use Profile → Privacy → "Export my data", or email us for a full copy, before you delete your account.
• By us. We may suspend or close your account, or disable content or links, if you break these Terms or the law, don't pay, create risk for students, other users or us, or if we stop offering the Service. Where reasonable, we will tell you first and give you a chance to export your content.
• Afterwards. Your right to use the Service ends. We may delete your content after 30 days, unless the law requires us to keep it. Sections that by their nature should survive (such as 8.2 for content already shared, and 14 to 19) continue to apply.

18. Disputes

18.1 Talk to us first

Before filing a claim, email support@easyclass.ai with a description of the problem. We will try to resolve it within 30 days.

18.2 Arbitration and class action waiver

If we can't resolve it, you and EasyClass agree that any dispute arising from or relating to the Service or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its applicable rules, not in court, except that either party may bring an individual claim in small claims court, and either party may seek a court order to stop infringement or misuse of intellectual property or unauthorized access to the Service. YOU AND EASYCLASS WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS OR REPRESENTATIVE ACTION.

This section does not apply to public schools or government agencies where the law does not allow it; for them, section 18.3 applies to any court proceeding.

18.3 Governing law and venue

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules, except where the law of your place of residence must apply. Any court proceeding allowed under these Terms will be brought in the state or federal courts located in Delaware.

18.4 Time limit

To the extent the law allows, any claim must be brought within one year after it arises.

19. General

• These Terms, the Privacy Policy, and any plan or order terms you accept are the entire agreement between you and us about the Service, unless your organization has a separate signed agreement with us.
• If a part of these Terms is found unenforceable, the rest stays in effect. Our not enforcing a right is not a waiver of it.
• You may not transfer these Terms without our consent. We may transfer them to an affiliate or a successor in a merger, acquisition or sale of assets.
• We may send notices to the email address on your account or in the Service. You can send notices to support@easyclass.ai or by mail to EasyClass AI, PO Box 44, Simpson, LA 71474, USA.
• We are not responsible for delays or failures caused by events beyond our reasonable control.
• Nothing in these Terms creates a partnership, employment or agency relationship, or gives rights to anyone other than you and us.

20. Changes to these Terms

We may update these Terms. For material changes, we will notify you by email or in the Service at least 14 days before they take effect, except for changes required by law or that address new features, which may take effect sooner. If you keep using the Service after changes take effect, you accept the new Terms. If you don't agree, stop using the Service and cancel your subscription.
